In accordance with the provisions of current national legal regulations, Royal Decree-Law 19/2018 and the EU transposing Directive (EU) 2015/2366 on payment services in the internal market; The purpose is to establish the transparency measures towards customers that are presented below through the conditions of a general framework of rights and obligations assumed by the parties in relation to the use of the money transfer service.
Trans Fast Financial Services, S.A, E.P., CIF: A-83085217 (hereinafter Trans Fast, E.P or Entity) is a Payment Institution authorized by the Bank of Spain to provide the money transfer service and registered under registration No. 6813 through its Main Office located at Calle Batalla del Salado, 25 CP 28045 Madrid and through its Authorized Agents in Spain and the European Union (“EU”)
Definitions:
Agent: a natural or legal person who provides payment services on behalf of a payment service provider.
Correspondent Bank/Payer: Also called Payment Service Provider that is legally authorized to perform the transfer service to the beneficiary of the payment order.
Beneficiary: a natural or legal person who is the intended recipient of the funds that have been the subject of a payment transaction.
Business day: the day on which the payer or payee is open (every day of the year except Sundays and public holidays, whether international, national, regional or local), for the purposes necessary for the execution of a payment transaction, of the payer’s or payee’s payment service providers involved in the execution of the payment transaction.
Payment institution: a legal entity to which authorization has been granted to provide and execute payment services.
Value date: The time used by a payment service provider as a reference for calculating interest on funds credited or debited to a payment account.
Unique identifier: a combination of letters, numbers or signs specified by the payment service provider to the Originator of such services, which the latter must provide in order to unambiguously identify the other Payment Service Originator, your payment account in a payment transaction or both.
Payer/Sender: a natural or legal person holding a payment account who authorises a payment order from that account or, in the absence of a payment account, the natural or legal person issuing a payment order.
Payment order: any instruction sent by a payer or payee to its payment service provider requesting the execution of a payment transaction.
Payment service provider: credit institutions, payment institutions such as Trans Fast and other financial institutions and bodies referred to in Law 18/2019 on payment services.
Money sending/receiving service means a payment service that allows either funds to be received from a payer without any payment account being created in the name of the payer or payee, for the sole purpose of transferring an equivalent amount to a payee or another payment service provider acting on behalf of the payee, or to receive funds on behalf of the beneficiary and make them available to the beneficiary.
Reference exchange rate: The exchange rate used as the basis for calculating any currency exchange, whether provided by the payment service provider or from a publicly available source.
Remote operations: payment orders issued or received that have been channelled by telephone or online means through the Web or App service.
Payment service payer: the natural or legal person who makes use of a payment service, either as payer, payee or both.
Online Service: the activity carried out by the payment institution as a channel that allows users to carry out their operations remotely. This service may be through web interface systems and/or Apps identified as Trans Fast or those of its authorized agents.
Description of the Services provided by the Payment Institution:
On-site / Remote Money Transfer/Reception Service:
The money transfer service authorizes the Sender to allow the Sender either in its capacity as the real owner or as authorized to send money from/to abroad through any face-to-face, technological or remote means.
Money transfer service through the “On-line” system (by web or App):
It is a payment mechanism in foreign currency carried out by Trans Fast, EP by electronic transfer of funds, on behalf of the Originator of the service and in favor of individuals resident in other countries.
Main features of the Service:
Fast and secure payment system.
Service with international coverage through correspondent banks.
Through this mechanism, international payments are made for family remittances.
It can be made in any internationally quoted currency
Identification System for any option of the Money Transfer/Receive Services: (Face-to-face / Remote / Online)
Data to be provided by the Originator and Beneficiary:
Individuals: Original and valid identity document DNI, passport, residence card (NIE), or (other valid identity document in the country of origin that includes a photograph of its holder and signature in accordance with current legal regulations), economic or professional activity, address, telephone number, concept for which the operation is carried out and amount in euros to be sent.
Legal Persons: copy of the original of the articles of incorporation, copy of the original identity document of the Beneficial Owner (natural person acting in the name and representation of the company), document accrediting the tax identification (NIF) and address.
Important, if the Ordering Party acts on behalf of another person, he/she must prove the powers of representation and the identification of the Ordering Party on behalf of which he/she is acting.
Information to be provided by the Beneficiary: Full names and surnames, telephone number, city, country, amount, currency and concept of the order, method of payment. If it is to be deposited in a bank account at destination, name of the Bank, number and type of bank account. And in some cases depending on the conditions of each country, beneficiary’s identity card number, full address, town, type of relationship and email (optional).
Authorisation of the payer to third parties.
The Ordering Party may authorise another person, by means of a power of attorney or in writing signed by both the authorising party and the authorised person in the presence of the staff of Trans Fast Financial Services S.A., E.P.
The ordering party exonerates Trans Fast Financial Services S.A., E.P., from any claim against it in the event of having made use of the powers of attorney or revoked, modified, limited or extinguished signatures, provided that Trans Fast Financial Services S.A., E.P., has not previously received communication of the aforementioned variation.
For Ordering Agents who make a shipment in a non-face-to-face manner by telephone or On Line; It will be managed in accordance with the following:
In the case of Telephone Assistance: The identity of the Ordering Officer of the service is accredited in accordance with the provisions of paragraphs a) b) and c) of section 2.1.
And with respect to the means of payment, the first deposit will have to come from an account in the name of the same Originator of the service opened in an entity domiciled in Spain, in the European Union or in equivalent third countries.
The Originator may only make transfers exclusively and without exception to Trans-Fast, E.P., in one of our bank accounts intended for this purpose; and under no circumstances will the client transfer to bank accounts in the name of authorized agents (natural or legal persons) or third parties other than Trans Fast Financial Services, S.A., E.P.
In the case of the Online Service: the Originator will have to register through the web portal or the App authorized to operate in the name and on behalf of Trans Fast, E.P., filling in the requested formal identification data; send the identification document: valid DNI / NIE / Passport.
For New Trans Fast Ordering Agents (customers), Trans Fast reserves the right to request that the first deposit be made by making a bank transfer from an account that the payer is the holder of and thus accrediting it. The Entity’s Compliance Department, when required, will request additional documentation to execute the operation.
For Beneficiaries who receive a submission in a non-face-to-face manner; It will be managed in accordance with the following:
Your identity document will be requested, which must be valid and fill in the formal identification information (country of origin, nationality, residence, economic or professional activity) prior to payment of the order.
Trans Fast reserves the right to request that you prove the bank ownership of the Beneficiary prior to the execution of the order in your bank account to verify the ownership data.
In compliance with Law 10/2010, of 28 April, on the prevention of money laundering and terrorist financing, Trans Fast, E.P. will request the Originator to complete and sign a know-your-customer form; and provide additional information when: (i) the amount sent exceeds the maximum time limit of €3,000, in a single transaction or cumulatively over a period of three calendar months; (ii) when the regulations in force in the country of origin where the Entity operates establish the minimum amounts of identification and knowledge; (iii) policy of the Entity so requires.
The Ordering Party must provide proof of his/her work, economic or professional activity, declarations of origin and destination of the funds, place of stay in Spain (certificate of registration, invoice or bank receipt stating his/her name and address, etc.), proof of payment of funds (payroll, etc.).
For any inquiries regarding the address of the place for shipping/receiving an order and/or Trans Fast, EP bank account number, the payer/payee can contact the telephone number indicated in section 11 of customer service.
Senders who make attempts not to fill in the requested data, minors or those customers who do not provide the reliable documentation requested by Trans Fast, EP, or those Ordering Agents who reserve the right of Non-Admission, are not admitted.
The receipt of the operation executed shall be understood to have the same validity as the handwritten signature and shall have full probative value in relation to the instructions or statements made through them.
Trans Fast, EP will not request from the Originator or Beneficiary any type of data, information, document or completion of forms by any means either by telephone, by SMS, email or WhatsApp after the execution of a payment order for the transfer/receipt of money.
Fees, commissions and expenses, exchange rate of the service:
Payment of Commissions and Expenses:
The money transfer service will accrue a maximum fixed fee of €12 plus a maximum percentage fee of 6%, which will be borne by the Originator.
There will be no cost for the issuance of certificates. This certificate will be limited to including the data related to the payer/beneficiary’s data related to: number and date of the transaction, names and surnames of the beneficiary(s), country of destination, amount in euros and the equivalent value of the currency of the country of destination.
The rates and commissions of the service offered by Trans Fast E.P. will be duly updated and published in a perfectly visible place in our Main Office; and at the premises where our Authorised Agents operate in the EEA.
In the event that the currency purchase and sale service will not accrue any commission in favor of Trans Fast, E.P., and the updated reference exchange rate published on the website and in the Main Office will be applied.
All commissions and expenses in sending money are borne by the Sender; the beneficiary will receive the full amount shown on the invoice delivered to the Originator and in the currency that the Originator has decided to send.
The Correspondent may not charge the beneficiary any commission for the service, or for any other reason, except those required by local legislation or those that have been previously agreed.
In all cases, the reference exchange rate and commissions applied will be communicated to the Originator prior to the issuance of the order, will be printed on the invoice and will be signed by the Originator as acceptance of the transaction.
Exchange rate:
Trans Fast calculates the currency based on the exchange rates obtained in the market plus a margin. Most currency exchange rates can be adjusted several times a day based on the closing prices of national and international financial markets. The exchange rate is published on the website in www.trans-fast.es you must choose the country of origin, the country of destination, the amount you want to transfer and click on “Calculate”.
As a general rule, the beneficiary will receive the full amount reflected on the invoice, however, in some countries local regulations require that money transfers (i) are converted only at the time of payment, the above exchange rate is only an estimate and the actual exchange rate will be determined at the time of payment, (ii) orders are settled in round amounts or multiples.
Delivery time of payment services:
4.1) For the Face-to-Face / Remote Shipping Service:
Payment orders are normally ready to be collected by the beneficiaries within a maximum period of 24 to 48 working hours (Monday to Friday), counted from the moment the payment order is transmitted to the correspondent, except for special destinations and/or bank deposits for which the maximum period will be 72 working hours. For the calculation of these periods, only banking working days will be considered.
These deadlines may be automatically extended when the transaction requires additional verification by the Legal Compliance Department, in accordance with paragraph 2.4 of these Conditions.
4.2) For the shipping service through Trans Fast On Line System:
The delivery time of the consignment at destination ranges from 2 to 72 business hours (Monday to Friday). In the event that the Originator has applied to make the payment order and has not made the deposit or transfer to the Trans Fast, EP account within the following 72 hours, the order will be deleted without prior consent or withdrawal by the Originator due to fluctuations in exchange rates. Therefore, he will have to manage this operation again.
4.3) For the payment service of orders received:
Delivery times for payment orders received in Spain are immediate (when they are made over the counter) while through bank deposit it can range between 24 and 72 hours working days.
The service may apply other restrictions beyond Trans Fast’s control that may suffer delays in your payment service, in which case you may be notified by your Authorized Agent through our customer service.
Authorisation of payment transactions.
Payment transactions shall be deemed to have been authorised when the Originator has given consent to their execution. In the absence of such consent, the payment transaction will be considered unauthorised. It is understood that such consent is unequivocal when the Originator signs the invoice in the capacity of execution of the payment order.
Confirmation of the availability of funds.
The beneficiary must show a valid and valid ORIGINAL identification document in order to withdraw the money. In some cases, you will also be asked for a key number that is a Unique Identifier, which will be communicated to the Originator at the time of carrying out the operation, or directly to the beneficiary when they are notified to go and withdraw the amount of the payment order.
Payments can be made in cash, cheque/cheque or both and by bank deposit into the beneficiary’s account, in the currency of the destination country, USD and/or Euros, when requested by the Originator and at the destinations where this bank account transfer service is available. The payer will be informed of the address, telephone numbers and hours where the beneficiary must go to collect his money. And in some cases the beneficiary will be notified by phone or via whatsapp that their transfer is ready to be collected.
Payment orders executed incorrectly.
When the Originator becomes aware that a payment transaction has been executed incorrectly, it must notify Trans Fast without undue delay, in order to be able to rectify the omission or error committed. If it is impossible to rectify the error and it is attributable to Trans Fast, the Entity will refund the total amount of the money transfer order to the Sender.
On the other hand, if the error is attributable to the Originator, it will be up to the Originator to assume the incident generated by the erroneous data provided by the sending of the payment order, therefore, the amount will not be refunded as commission; and in the event of requesting its refund, it will be in accordance with the form and deadlines established in the Entity’s Return Policy.
It shall be understood that the execution of a new payment order due to an error or omission of the beneficiary’s data by the payer, the delivery period to the beneficiary shall begin from said new order authorised in accordance with the provisions of paragraph 4.
Non-execution or defective execution of a payment order made.
Trans Fast, EP will be responsible to the Originator for the correct execution of the money transfer operation, until the moment when the amount is paid to the beneficiary.
In the case of payment transactions, Trans Fast’s liability extends until the amount of the money transfer order is credited to the account of the beneficiary’s payment services correspondent. Once this payment has been made, the beneficiary’s payment services correspondent will be responsible to the beneficiary for the correct execution of the transaction.
In the case of payment transactions that have not been executed or are defectively executed, when the Institution is liable to the Originator, it shall return the amount corresponding to the transaction to the Originator without undue delay, in accordance with the terms established in the Payment Institution’s Return Policy.
Where the payee’s payment services correspondent is the person responsible for the payment services in accordance with the preceding subparagraph, the latter shall immediately make available to the payee the amount corresponding to the payment transaction.
In any case, Trans Fast, EP will try to find out immediately, upon request and regardless of its responsibility, the data relating to the payment transaction and will notify the Ordering Party of the results.
Money-Back Policy:
The Originator of the payment service will request to process the deletion or cancellation through the main office, of the Agent Network; as well as those who operate through the Trans Fast On Line platform.
The reimbursement to the Originator of the amount of the payment order will occur in the event that the fault is not attributable to Trans Fast, EP will be refunded the nominal amount, without commission and expenses paid in relation to it, when there is: a) Impossibility of delivery of the transfer, due to error or omission in the identification data of the beneficiary provided by the Originator of the service. b) the identification presented by the Ordering Party is not valid including the option c) that the beneficiary does not withdraw the transfer.
In the event that the causes are attributable to Trans Fast, EP, the Originator of the payment service, has the right to request a full reimbursement of an executed transaction, including expenses and commissions.
At the request of Trans Fast, EP, it shall be for the Ordering Party to demonstrate that such conditions are met where the following occurs: (i) The shipment did not specify the exact amount of the transaction; (ii) The amount of the transaction exceeds the amount that the payer could reasonably expect taking into account the above expenditure patterns, these general conditions and the relevant circumstances.
In the event that the Originator of the payment service requests to process the deletion or cancellation through the Trans Fast On Line Service: (Non-Face-to-Face Operations)
In accordance with the Specific Conditions of the Trans Fast On Line Service: You may register such request on the Trans Fast On Line Service Website in the Incidents access, where the Entity’s Customer Service will contact the Originator by telephone.
At any time, you can go to the main office of the Entity, to the address indicated in point 14 of the Conditions or through the Network of Authorised Agents where you can fill in the cancellation form and start this procedure.
In both cases, the Entity must complete and process the cancellation and refund within 72 hours (understood between business days) from the request for the elimination/cancellation, deducting, if necessary, the service charges for commission.
The Originator may not invoke reasons related to the currency exchange when the reference exchange rate has been applied, which is visible for information purposes prior to the acceptance of the shipment of the order, or through the Trans Fast On Line portal or on the Entity’s Website where it indicates “Change of the day”, in accordance with the particular conditions of the Trans Fast On Line service.
In any of the cases indicated above, the Entity will contact the Originator of the service to proceed with the corresponding refund or refund; in accordance with the indications expressed in this policy that indicates payment method, type and time of reimbursement.
The means of payment used for the execution of the refund or refund will be through the same means that the operation was carried out. As established in the Sole Annex of the Payment Institution’s Return Policy.
If the Originator of the service is not satisfied with the service provided, they may file their complaint or claim, since the Entity has a CUSTOMER Service Area that is responsible for the attention and resolution of queries, complaints and claims submitted by its Ordering Parties, in relation to their legally recognised interests and rights. The data is set out in point 14 of the aforementioned General Terms and Conditions of Service.
Trans Fast, EP may refuse to execute an order to send or pay money, when the payer or beneficiary refuses to provide any information or documentation required in these general conditions, or in application of the internal policy on the Prevention of Money Laundering, notifying the Originator of the service of such refusal and, as far as possible, the reasons for it, as well as what must be done to rectify the possible errors or omissions of fact that have motivated it
The Particular Conditions of the Trans Fast On Line Service also express the Return Policy.
Special Statement:
Trans Fast E.P reserves the right to request additional documentation that accredits the activity, funds and other frameworks for the treatment of the service prior to the execution of the order in accordance with the regulatory and legal provisions of the country of origin and/or destination of the order as expressed in section 2 of this document.
Liability of the Parties:
In no case shall Trans Fast E.P be liable for damages or negligence of one or more of its indirect special, incidental, consequential obligations or for loss of profit, in terms of: The liability of the Originator in the event of payment transactions not authorised by the latter, when providing passwords to third parties, access codes and bank details (credit/debit card/Bizum) to manage money transfers.
Likewise, Trans Fast E.P shall not be liable and the Originator shall not be liable if the Originator himself uses knowingly and intentionally or even when he invokes an “error” in the use of a means of payment (cash/card/transfer/Bizum) of which he is not the owner.
However, Trans Fast has a two-factor verification process, which means that the owner of the card (credit/debit/Bizum) will have to authorize the purchase by applying the password to their bank to consent to the confirmation of the payment.
We also assume no responsibility for:
i) errors resulting from incomplete or incorrect information provided by the payer or third party;
ii) access to your unsaved data on your various devices that could be used by third parties;
iii) unauthorized use of information before it reaches the Website or Trans Fast OnLine;
The payer shall be solely responsible for ensuring that the payment method used: (i) you have sufficient funds or credit available for the execution of your Payment Transaction; (ii) safeguarding your passwords and passwords to preventively prevent any improper use by third parties of your means of payment.
We have no obligation to the Originator to initiate or execute an order, in the event that:
We cannot obtain sufficient proof of your identity;
there are indications that the transaction information is false, unauthorized or falsified;
you have provided incorrect or incomplete data or we did not receive the information about your transaction in time to ensure the execution of the order;
The card issuer does not authorize the use of your bank card to pay for the transaction and our fees.
Protection of Payment Service Originators’ Funds:
The Entity will protect the funds received from the Originators of its payment services subject to the procedure set out in Article 21.1, section a), of Law 18/2018, of 23 November, on payment services. Therefore, funds received from Originators shall not be commingled at any time with the funds of any natural or legal person other than Payment Service Originators on whose behalf the funds are disposed of and, in the event that they are still in the possession of the Entity and have not yet been delivered to the beneficiary or transferred to the Correspondent by the end of the business day following the day on which they were received The funds will be kept in the open deposit account that functions as a guarantor of the funds and is detailed below:

In this case, the holders of the funds shall have the right of separation over the account referred to in the preceding paragraph, in accordance with the regulations in force, for the benefit of the Payment Service Senders, with respect to possible claims by other creditors of Trans Fast, in particular in the event of insolvency.

Recipient of Assignments or Transfers TRANSFAST will not communicate the data of the users to third parties. However, in the event of being transferred to a company, information would be produced prior to collection, requesting the express consent of the affected party.
Data retention periods These data will be kept for the time necessary for their function or the maximum established by the corresponding tax legislation.

Trans Fast E.P. reserves the right to adopt all the rules and security measures it deems appropriate to guarantee the proper use and confidentiality of the service.
The Originator authorises Trans Fast E.P. not to execute orders received when the identification of the payer and/or beneficiary, data or amount of the payment order are not correct and/or have reasonable doubts as to the identity of the person who is issuing the orders in question.
Trans Fast will inform the payer that the conversations that arise as a result of the Payment Institution’s service may be recorded, and/or record all communications and transactions that are maintained due to the use of the Remote Services.
The Ordering Party may obtain a copy of the content of the communications free of charge, however, the Ordering Party may require that the procedure be carried out through a means other than that used by Trans Fast, EP; however, the disproportionate costs resulting from its choice will be borne by the Ordering Party.

In the event that the CLIENT wishes to make a complaint for the service provided and has provided all the necessary data to make their claim, Trans Fast, E.P. will resolve it no later than fifteen (15) working days after receipt of the complaint.
In exceptional situations, if a response cannot be provided within fifteen (15) working days for reasons beyond the control of Trans Fast, EP, Trans Fast, EP must send a provisional response, clearly stating the reasons for the delay in responding to the complaint and specifying the time frame within which the Payment Services Originator will receive the final response. In any case, the deadline for receipt of the final response shall not exceed one (01) month.

Online Consumer Dispute Resolution: (known as the “ODR Regulation”)
The Originator of the money transfer service has at its disposal the possibility of alternative dispute resolution as a result of a claim for the service provided.
To do this, certain requirements must be met:
1. The parties may submit their claims, as well as any documentation required, online or offline. In the event that it is not possible for the parties to use electronic means, Banco de España must make it possible for them to be submitted by any other means that allows the identification of the claimant.
2. As soon as the Banco de España to which a complaint has been lodged receives all the documentation with the relevant information in relation to the complaint, after correcting it where appropriate, it shall immediately notify the parties, indicating, by any means that allows it to be recorded, the date on which said complete receipt took place.
Duration of the procedure:
The result of the procedure must be made known to the parties within a maximum period of ninety (90) calendar days from the date of submission of the claim or, where appropriate, from the date on which it is recorded on a durable medium that the complete and necessary documentation has been received to process the procedure.
The European Consumer Centre and the public administrations with competence in consumer protection matters shall provide links between their websites and the website or websites of the European Commission containing the consolidated list of entities accredited and notified by the different Member States.

Resolution. Governing Law and Jurisdiction.
These General Conditions will be governed by Spanish law. Any dispute will be resolved before the corresponding courts or tribunals of the autonomous communities of Spain.
SOLE ANNEX. RETURN POLICY.
The Entity must complete and process the cancellation and refund within 72 hours (understood between working days (every day of the year except Sundays and holidays, whether international, national, regional or local), from the request for the elimination/cancellation, deducting, if necessary, the service charges for administrative expenses incurred.
If the CLIENT is not satisfied with the service provided, they may file their complaint or claim, since the Entity has a CUSTOMER Service Area that is responsible for the attention and resolution of complaints and claims submitted by its CLIENTS, in relation to their legally recognized interests and rights.
How and when refunds are made:
Payment method: Credit / debit card / Bizum
Type of refund: Ordinary refund on the same credit/debit card and for the Bizum system on the same account linked to Bizum.
Estimated refund time: Between 2 and 12 business days* (depending on the Issuing and Receiving Bank, in which case it may not exceed 15 business days). In the case of the Bizum system, it is understood that it will be immediate.

TRANS FAST ONLINE SERVICE
TRANS FAST, EP FINANCIAL SERVICES, S.A., E.P.
Overview.
In accordance with the provisions of current national legal regulations, Royal Decree-Law 19/2018 and the EU transposing Directive (EU) 2015/2366 on payment services in the internal market; The purpose is to establish the transparency measures towards the Ordering Party, which are presented below, through the conditions of a general framework of rights and obligations assumed by the parties in relation to the use of the money transfer service in relation to payment orders made over the Internet (hereinafter “TRANS FAST ON LINE” or “SGD”). The following Specific Conditions of the TRANS FAST ON LINE Service will be applicable to said service, in case of discrepancy, they will prevail over the General Conditions of the Entity.
Trans Fast Financial Services, S.A, E.P., CIF: A-83085217 (hereinafter, “Trans Fast, EP” or “Entity”) is a Payment Institution authorized by the Bank of Spain to provide the money transfer service and registered under registration No. 6813 through its Main Office located at Calle Batalla del Salado, 25 CP 28045 Madrid and through its Authorized Agents in Spain and the European Union (“EU”)
These documents will be available at all times on durable support in the main office and on page www.trans-fast.es; as well as in the Network of Authorised Agents of the Payment Institution and the PAYER has had access to them prior to contracting the Service.
The scope of application of these Specific Conditions is to regulate the conditions under which the PAYER may contract, order operations, give instructions, consult the status of their payment orders and, in general, communicate with Trans Fast, EP by telephone and Internet, through the identification and security system established by the Entity.
Concept of the TRANS FAST ON LINE service:
It is a payment mechanism in foreign currency made by the Payment Institution by electronic transfer of funds, on behalf of its PAYERS and in favor of individuals residing in other countries.
Main features of the Service:
Fast and secure payment system.
Service with international coverage through correspondent banks.
Through this mechanism, international payments are made for family remittances.
It can be made in any internationally quoted currency.
Who the Service is for:
It is aimed at consumers and users, whether they are individuals or legal entities, who wish to send money from Spain.
Requirements to qualify for the Service:
Be a PAYER linked to the services of Trans Fast, EP.
Register through the Trans Fast, EP web portal, filling in the requested data.
Make the first deposit by transfer from an account opened by the payer in Spain or a country of the European Union or equivalent third parties to the account indicated by Trans Fast, EP.
Provide the Legal Compliance Department of the Entity with any request for documentation required to execute the payment order.
The delivery time of the consignment at destination ranges from: 2 to 72 business hours.
The following are not admitted: Attempts not to fill in the requested data, minors or those ORDERING PARTIES who do not provide the requested documentation, or those indicated in the Money Laundering Prevention Manual.
1.- Contracting of the TRANS FAST ON LINE Services.
1.1.- The PAYER may make inquiries through the web portal or the www.transfastonline.com channel available at any time regarding the status of their payment order and operations; as well as request any modification and cancellation of the operation.
1.2.- This service expresses the Specific Conditions of the payment order services through the TRANS FAST ON LINE system, which may be contracted by residents in Spain and the EU.
1.3.- In cases where, through the channels made available by Trans Fast, EP, any promotional service offered by the Entity is contracted that previously requires the updating of any personal data of the PAYER, the expression of will of the ORDERING PARTY will be necessary both for the initial registration of the TRANS FAST ON ONLINE service and for face-to-face operations.
The initial application of the data of a new PAYER, i.e. one that has not previously operated with the Entity, will not imply the subscription of those promotional services that Trans Fast, EP offers at that time to its PAYERS. The contracting of the promotional service will require: a) an express expression of will by the ORDERING PARTY and b) that it meets the specific conditions established for the promotion.
In any case, the subscription to any promotional service offered by Trans Fast, EP will also be subject, once the TRANS FAST ON LINE Service has been subscribed, to compliance with the general conditions of the Payment Institution.
2. Identification of the User of the TRANS FAST ON LINE Service.
The Service is nominative and non-transferable.
All new or existing PAYERS, individuals who use the Trans Fast, EP Services, are obliged to provide, under the terms established by current legislation, to the Payment Institution a copy of their National Identity Document, or equivalent in force at the time of establishing relations with the Entity, being conditioned the functionality and availability to make payment orders, in accordance with the internal policy on the prevention of money laundering and terrorist financing.
All those persons who appear as ORDERING PARTIES of the Trans Fast, EP Services will jointly and severally assume all the rights and obligations derived from the actions of any of them. The PAYER may not authorise a third party (hereinafter, the “Authorised Party”), duly identified, to make payment orders on behalf of the latter.
Trans Fast, EP will not ask you for the payment or receipt of your payment order once the invoice has been issued and the Payer Identification Form has been completed for any data, information or document of a personal nature by any means, whether by telephone, SMS, email or WhatsApp.
3. Operation of the TRANS FAST ON LINE Service.
3.1. In order to be able to have access to the TRANS FAST ON LINE Service and to give any type of instruction, once the ORDERING PARTY accepts the Privacy Policies and General Conditions Trans Fast, EP will send an email in which it will assign the ORDERING PARTY the corresponding security elements to access the TRANS FAST ON ONLINE platform.
The security elements together with the number of the Identity Document, (DNI, NIE or Passport) if applicable (hereinafter “Supporting Document”), and the telephone number will be essential to operate with Trans Fast, EP. The PAYER accepts for authentication, the use of any type of keys, codes or security elements for the execution of the payment order provided by the Entity.
Trans Fast, EP may proceed to revoke or cancel the security elements in the event that it has reasonable indications that they may have been compromised due to loss, misplacement, theft, theft or unauthorized use of any element or payment instrument or due to the inability of the PAYER. In order to increase the security of operations and payment orders, Trans Fast, EP may refuse to execute orders and instructions received by means not authorised by the Entity for normal operations (such as email) or those that have not been validated with the corresponding security elements. Such refusal shall in no case imply the assumption of any liability on the part of Trans Fast, EP.
Once the service registration process has been completed, and as an additional security measure to the user access credentials and personal password, Trans Fast, EP will provide the PAYER with the corresponding security elements, which is a one-time code automatically generated by the application that will be sent to the PAYER at their telephone number indicated in the service registration through SMS message.
This one-time code sent via SMS will occur when:
Access to view or edit your personal data
Add a new payee to the money order
Validate the transaction amount
Try to access after 21 days of inactivity.
These security elements will be applied prior to validating the amount of the payment order by the PAYER to continue with the process of issuing the payment.
Otherwise, after the maximum session time in the TRANS FAST ON LINE application has elapsed without obtaining the validation of the security elements, Trans Fast, EP will proceed not to execute the payment order, having to initiate the process again by the PAYER.
3.2. The PAYER expressly undertakes not to reveal or provide its security elements to other people and to keep them in a safe place (i.e. those provided by your Banking Institution such as debit and/or credit cards or password to operate through Bizum). In the event of loss or theft of the security elements, the ORDERING PARTY must notify Trans Fast, EP without undue delay. For these purposes, an undue delay will be considered to occur when there is no notification prior to the execution of the order, where applicable, and the ORDERING PARTY becomes aware of the occurrence of the aforementioned facts.
Until this communication is made, the ORIGINATOR will be responsible for any operation carried out with its security elements, and Trans Fast, EP will be released from any liability that may arise as a result of operations in which the number of the Supporting Document and/or the corresponding security elements are indicated. In the event of suspected compromise of any of its security elements, it must, in addition to notifying Trans Fast, EP without undue delay, proceed to block and/or change its passwords.
3.3. Trans Fast, EP may limit, with prior notice or by policies of the Payment Institution, the number per day and amount of payment orders made for the service.
3.4. Trans Fast, EP will not assume any responsibility for the actions of the operators of the means of communication (telephone, mail, Internet, etc.) unrelated to Trans Fast, EP used by the ORDERING PARTIES.
Trans Fast, EP is not liable for any damages that may arise for the ORIGINATORS or for third parties as a result of the non-receipt or late receipt of communications for reasons attributable exclusively to said operators outside Trans Fast, EP used by the ORDERING PARTIES.
3.5. Trans Fast, EP will not be responsible for the non-execution or delay in the execution of any operations if such lack of execution or delay is the result of a case of force majeure, fortuitous event or, in general, any circumstance that occurs to the PAYER and in which Trans Fast cannot have direct control. EP (such as power and/or telephone supply cut that affects the PAYER, computer viruses in its equipment, deficiencies in its telecommunications services or the compromise of passwords, security or identification elements).
3.6. Trans Fast, EP may provide any information that, being relevant, is not of a personal nature to its PAYERS, through its website.
3.7. Trans Fast, EP cannot issue any payment instruments; therefore, the user exempts from liability any information through any of the means of communication that leads to the assumption that the Entity provides services other than the one to which it is legally subject.
3.8. Trans Fast, EP urges users of the TRANS FAST ON LINE Service to use the payment instruments (debit and/or credit cards, ATMs and transfers, Bizum system) in accordance with the conditions that regulate their issuance and use according to the Banking Entity to which said payment instrument is linked. taking in particular all reasonable measures to protect the personalised security elements with which it is provided. In the event of loss, theft, theft or unauthorised use of any element or payment instrument, the PAYER must notify Trans Fast and its corresponding Banking Entity as soon as it becomes aware of the occurrence of such circumstances and without undue delay. For these general purposes, an undue delay will be considered to occur when there is no notification prior to the execution of the order, where applicable, and the ORDERING PARTY becomes aware of the occurrence of the aforementioned events.
Trans Fast, EP will not be liable for any damages that may occur to the ORDERING PARTY in the event that such notification is not given or it occurs with undue delays, as defined in the previous paragraph.
The PAYER, with respect to an unauthorised payment transaction, will be subject to the responsibilities and obligations established in the General Conditions of the Entity as long as they have not been the result of the deliberate breach or gross negligence of the obligations established in this Agreement, and in the regulations in force for this purpose. It is mentioned:
In no case shall Trans Fast E.P be liable for damages or negligence of one or more of its indirect special, incidental, consequential obligations or for loss of profit, in terms of: The liability of the Originator in the event of payment transactions not authorised by the latter, when providing passwords to third parties, access codes and bank details (credit/debit card/Bizum) to manage money transfers.
Likewise, Trans Fast E.P shall not be liable and the Originator shall not be liable if the Originator himself uses knowingly and intentionally or even when he invokes an “error” in the use of a means of payment (cash/card/transfer/Bizum) of which he is not the owner.
However, Trans Fast has a two-factor verification process, which means that the owner of the card (credit/debit/Bizum) will have to authorize the purchase by applying the password to their bank to consent to the confirmation of the payment.
We also assume no responsibility for:
i) errors resulting from incomplete or incorrect information provided by the payer or third party;
ii) access to your unsaved data on your various devices that could be used by third parties;
iii) unauthorized use of information before it reaches the Website or Trans Fast OnLine;
The payer shall be solely responsible for ensuring that the payment method used: (i) you have sufficient funds or credit available for the execution of your Payment Transaction; (ii) safeguarding your passwords and passwords to preventively prevent any improper use by third parties of your means of payment.
We have no obligation to the Originator to initiate or execute an order, in the event that:
(a) We are unable to obtain sufficient evidence of your identity;
(b) there are indications that the transaction information is false, unauthorized or falsified;
c) you have provided incorrect or incomplete data or we did not receive the information about your transaction in time to ensure the execution of the order;
d) The card issuer does not authorise the use of your bank card to pay for the transaction and our fees.
4. Cash deposit, transfers and other means of payment.
Without prejudice to the provisions for each of the services provided by the Entity in its General Conditions and those described in these particular conditions, Trans Fast, EP may restrict entry operations that have their origin or destination in certain countries either because they are considered tax havens or following the recommendations of the Financial Action Task Force (FATF) or other national or international bodies or organizations. or in accordance with internal policies of Trans Fast, EP.
Enforceable policy to apply to the TRANS FAST ON LINE service for both New and Existing PAYERS who have made payment orders in person.
a) By means of a contribution of funds through a cash deposit in an account (ATMs or Banking Entity) of Trans Fast, EP (only those indicated by Trans Fast, EP at the time of executing the operation, or through confirmation via telephone by the PAYER service area of the Entity), opened in a bank branch in Spain.
Trans Fast, EP will not use any means of communication to disseminate and invoke or motivate unauthorized deposits into your accounts opened in Spain or any other country.
b) Through Debit or Credit Cards or Bizum (ATMs or the Trans Fast web portal, EP TRANS FAST ON LINE service). At the time of carrying out the operation, the PAYER must enter as a security element a one-time code provided by the Entity to validate the execution of the payment order, as indicated in section 3 numeral 3.1 of these Conditions.
The means of payment through Debit or Credit Cards will be through the use of the virtual POS service contracted with a payment method provider (hereinafter “Banking Entity”) considering the necessary security measures that guarantee the service user its application. Without prejudice to the provisions of point 3 of these Conditions.
Once validated by Trans Fast, EP the PAYER will continue to execute the operation including the debit or credit card data or Bizum system of its issuing Bank, in which it will have to apply a one-time code through the security elements that its Bank has assigned to it to authenticate the operation; These can be your coordinate card, PIN, or any other code or key.
c) By bank transfer from the PAYER’s open account to the Trans Fast, EP account.
The funds from contributions made through any of these means of payment, once they are made effective in the bank account of Trans Fast, EP, will guarantee their sending to their destination and will be delivered firmly to the Beneficiary in accordance with the deadlines indicated in Point 5 and in accordance with the General Conditions in Force.
Trans Fast, EP reserves the right to cancel all or part of the firm payments of the aforementioned operations, provided that the operation meets the Entity’s risk criteria.
5.- Delivery times through the TRANS FAST ON LINE service.
The delivery time of the payment order at destination will vary, and these may be between 2 and 72 working hours (every day of the year except Sundays and holidays, whether international, national, regional or local). In the event that the PAYER has applied to make the payment order and has not made the deposit or transfer to the Trans Fast, EP account within the following 72 hours, the order will be deleted without prior consent or withdrawal by the payer due to fluctuations in exchange rates. Therefore, he will have to manage this operation again.
5.1) Payment transactions executed incorrectly.
When the payer becomes aware that a payment transaction has been executed incorrectly, he must notify Trans Fast, EP without undue delay, in order to be able to rectify the omission or error committed. If it is impossible to rectify the error and it is attributable to Trans Fast, EP, the Entity will refund the amount of the money transfer order to the Sender.
On the other hand, if the error is attributable to the Originator, it will be up to the Originator to assume the incident generated by the erroneous data provided by the sending of the payment order, therefore, the amount will not be refunded as commission; and in the event of requesting its refund, it will be in accordance with the form and deadlines established in the Entity’s Return Policy.
It shall be understood that the execution of a new payment order due to an error or omission of the beneficiary’s data by the Sender, the delivery period to the beneficiary shall begin from said new order authorised in accordance with the provisions of section 4.
5.2) Non-execution or defective execution of a transaction by sending money made.
Trans Fast, EP, will be responsible to the Originator for the correct execution of the money transfer operation, until the moment when the amount is paid to the beneficiary.
In the case of payment transactions, Trans Fast, EP’s liability will extend until the time when the amount of the money transfer order is credited to the account of the payee’s payment services correspondent. Once this payment has been made, the beneficiary’s payment services correspondent will be responsible to the beneficiary for the correct execution of the transaction.
In the case of payment transactions that have not been executed or are defectively executed, when the Institution is liable to the Originator, it shall return the amount corresponding to the transaction to the Originator without undue delay, in accordance with the terms established in the Payment Institution’s Return Policy.
Where the payee’s payment services correspondent is the person responsible for the payment services in accordance with the preceding subparagraph, the latter shall immediately make available to the payee the amount corresponding to the payment transaction.
In any case, Trans Fast, EP will try to find out immediately, upon request and regardless of its responsibility, the data relating to the payment transaction and will notify the Ordering Party of the results.
6.- Return or refund policy through the TRANS FAST ON ONLINE Service.
The Originator of the payment service will request to process the deletion or cancellation through the main office, of the Agent Network; as well as those that operate through the TRANS FAST ON LINE platform.
The reimbursement to the Originator of the amount of the payment order will occur in the event that the fault is not attributable to Trans Fast, EP will be refunded the nominal amount, without commission and expenses paid in relation to it, when there is: a) Impossibility of delivery of the transfer, due to error or omission in the identification data of the beneficiary provided by the Originator of the service. b) the identification presented by the Ordering Party is not valid including the option c) that the beneficiary does not withdraw the transfer.
In the event that the causes are attributable to Trans Fast, EP, the Originator of the payment service, has the right to request a full reimbursement of an executed transaction, including expenses and commissions.
At the request of Trans Fast, EP, it shall be for the Ordering Party to demonstrate that such conditions are met where the following occurs: (i) The shipment did not specify the exact amount of the transaction; (ii) The amount of the transaction exceeds the amount that the payer could reasonably expect taking into account the above expenditure patterns, these general conditions and the relevant circumstances.
In the event that the Originator of the payment service requests to process the deletion or cancellation through the TRANS FAST ON LINE Service: (Non-Face-to-Face Operations)
You may register such request on the TRANS FAST ON LINE service website in the Incidents access, where the Entity’s CUSTOMER Service will contact the Originator by telephone.
At any time, you can go to the main office of the Entity, to the address indicated in point 7 of the Conditions or through the Network of Authorised Agents where you can fill in the cancellation form and start this procedure.
In both cases, the Entity must complete and process the cancellation and refund within 72 hours (understood between business days) from the request for the elimination/cancellation, deducting, if necessary, the service charges for commission.
The Ordering Party may not invoke reasons related to the exchange of currencies when the reference exchange rate has been applied, which is visible for information purposes prior to the acceptance of the shipment of the order, or through the TRANS FAST ON ONLINE portal or on the Entity’s Website where it indicates “Change of the day”, in accordance with the particular conditions of the TRANS FAST ON LINE service.
In any of the cases indicated above, the Entity will contact the Originator of the service to proceed with the corresponding refund or refund; in accordance with the indications expressed in this policy that indicates payment method, type and time of reimbursement.
The means of payment used for the execution of the refund or refund will be through the same means that the operation was carried out. As established in the Sole Annex of the Payment Institution’s Return Policy.
If the Originator of the service is not satisfied with the service provided, they may file their complaint or claim, since the Entity has a CUSTOMER Service Area that is responsible for the attention and resolution of queries, complaints and claims submitted by its Ordering Parties, in relation to their legally recognised interests and rights. The data are set out in section 7.
Trans Fast, EP may refuse to execute an order to send or pay money, when the payer or beneficiary refuses to provide any information or documentation required in the General Terms and Conditions, or in application of the internal policy on the Prevention of Money Laundering, notifying the Originator of the service of such refusal and, as far as possible, the reasons for it, as well as what must be done to rectify the possible errors or omissions of fact that have motivated it
The Return Policy is also expressed in the General Conditions of Service.
7.- Duration, cancellation and withdrawal from the Contract.
7.1.- These Specific Conditions will have an indefinite duration, from the moment of their acceptance, remaining in force as long as the ORDERING PARTY maintains an active Trans Fast Service.
7.2.- The TRANS FAST ON ONLINE Service may be cancelled at any time by the ORIGINATOR by sending an email to the address of sac@transfastspain.com.
7.3.- Trans Fast, EP may resolve the same immediately, in cases of non-compliance by one of the parties (especially in cases where false data or manipulated documents have been provided and in cases where there are indications of fraud or money laundering) or in situations in which there are serious reasons that alter the circumstances that led to the celebration of this Service.
7.4.- Trans Fast, EP reserves the right to consider the TRANS FAST ON LINE service inactive in the event that no payment order has been made for a minimum period of one year, in which case Trans Fast, EP will consider said PAYER inactive.
Notwithstanding the foregoing, the ORDERING PARTY shall have the right at any time to expressly request Trans Fast, EP to exercise its right to cancel its personal data as a result of the TRANS FAST ON LINE service.
7.5.- In the Specific Conditions of the service, it will be expressly established whether the right of withdrawal is applicable, the exercise of which, if applicable, will be carried out as indicated in clause 9. This right shall be applicable exclusively to the PAYER considered as a Consumer.
8.- Protection of the funds of the Payment Service Senders:
The Entity will protect the funds received from the Originators of its payment services subject to the procedure set out in Article 21.1, section a), of Law 18/2018, of 23 November, on payment services. Therefore, funds received from Originators shall not be commingled at any time with the funds of any natural or legal person other than Payment Service Originators on whose behalf the funds are disposed of and, in the event that they are still in the possession of the Entity and have not yet been delivered to the beneficiary or transferred to the Correspondent by the end of the business day following the day on which they were received The funds will be kept in the open deposit account that functions as a guarantor of the funds and is detailed below:

In this case, the holders of the funds shall have the right of separation over the account referred to in the preceding paragraph, in accordance with the regulations in force, for the benefit of the Payment Service Senders, with respect to possible claims by other creditors of Trans Fast, in particular in the event of insolvency.

In the event that the CLIENT wishes to make a complaint for the service provided and has provided all the necessary data to make their claim, Trans Fast, E.P. will resolve it no later than fifteen (15) working days after receipt of the complaint.
In exceptional situations, if a response cannot be provided within fifteen (15) working days for reasons beyond the control of Trans Fast, EP, Trans Fast, EP must send a provisional response, clearly stating the reasons for the delay in responding to the complaint and specifying the time frame within which the Payment Services Originator will receive the final response. In any case, the deadline for receipt of the final response shall not exceed one (01) month.

10.- Online dispute resolution in consumer matters: (known as the “ODR Regulation”)
The Originator of the money transfer service has at its disposal the possibility of alternative dispute resolution as a result of a claim for the service provided.
To do this, certain requirements must be met:
1. The parties may submit their claims, as well as any documentation required, online or offline. In the event that it is not possible for the parties to use electronic means, Banco de España must make it possible for them to be submitted by any other means that allows the identification of the claimant.
2. As soon as the Banco de España to which a complaint has been lodged receives all the documentation with the relevant information in relation to the complaint, after correcting it where appropriate, it shall immediately notify the parties, indicating, by any means that allows it to be recorded, the date on which said complete receipt took place.
Duration of the procedure:
The result of the procedure must be made known to the parties within a maximum period of ninety (90) calendar days from the date of submission of the claim or, where appropriate, from the date on which it is recorded on a durable medium that the complete and necessary documentation has been received to process the procedure.
The European Consumer Centre and the public administrations with competence in consumer protection matters shall provide links between their websites and the website or websites of the European Commission containing the consolidated list of entities accredited and notified by the different Member States.

Trans Fast E.P. reserves the right to adopt all the rules and security measures it deems appropriate to guarantee the proper use and confidentiality of the service.
The Originator authorises Trans Fast E.P. not to execute orders received when the identification of the payer and/or beneficiary, data or amount of the payment order are not correct and/or have reasonable doubts as to the identity of the person who is issuing the orders in question.
Trans Fast will inform the payer that the conversations that arise as a result of the Payment Institution’s service may be recorded, and/or record all communications and transactions that are maintained due to the use of the Remote Services.
The Ordering Party may obtain a copy of the content of the communications free of charge, however, the Ordering Party may require that the procedure be carried out through a means other than that used by Trans Fast, EP; however, the disproportionate costs resulting from its choice will be borne by the Ordering Party.
12.- Resolution. Governing Law and Jurisdiction.
These Specific Conditions will be governed by Spanish law. Any dispute will be resolved before the corresponding courts or tribunals of the autonomous communities of Spain.
SOLE ANNEX. RETURN POLICY.
The Entity must complete and process the cancellation and refund within 72 hours (understood between working days (every day of the year except Sundays and holidays, whether international, national, regional or local), from the request for the elimination/cancellation, deducting, if necessary, the service charges for administrative expenses incurred.
If the CLIENT is not satisfied with the service provided, they may file their complaint or claim, since the Entity has a CUSTOMER Service Area that is responsible for the attention and resolution of complaints and claims submitted by its CLIENTS, in relation to their legally recognized interests and rights.
How and when refunds are made:
Payment method: Credit / debit card / Bizum
Type of refund: Ordinary refund on the same credit/debit card and for the Bizum system on the same account linked to Bizum.
Estimated refund time: Between 2 and 12 business days* (depending on the Issuing and Receiving Bank, in which case it may not exceed 15 business days) In the case of the Bizum system, it is understood that it will be immediate.
Payment method: Bank transfer
Refund Type: Regular Refund to the Same Bank Account
Estimated refund time: Between 2 and 3 business days from the time you submit the service cancellation request and the proof of the return request is checked.*
Payment method: Cash
Type of refund: Ordinary refund to the Client at the Main Office of the Entity, and/or bank transfer to the account of the payer opened in Spain or the equivalent third country of the account holder.
Estimated refund time: Between 2 and 3 business days from the time you send the request to cancel the service and the proof of the return request is checked.
*This period takes into account the processing of the refund by the Correspondent (Payer); which can be between 2 and 3 working days (every day of the year except Sundays and holidays, whether international, national, regional or local)
